By Robert J. Kossack, Esq.

On Saturday, January 21, 2012, I went to one of the Nevada Democratic party caucuses. The one I went to was held in the Sierra Vista High School gymnasium about a half mile from my house in Rhodes Ranch. There were about 15 to 20 precincts represented at that one location. Other clusters of precincts met at other high schools and public facilities around the state. Registered Democrats living in any one of the precincts among those represented in the Sierra Vista High School gym, or anyone within one of those precincts who wanted to register as a Democrat right then and there outside the gym, could come in and spend about an hour of their time, maybe more if they had an active precinct, and participate in the Nevada Democratic caucus presidential candidate nomination process.

The head Democrat at the caucus was the site coordinator. He had arrived an hour before me with some staff members. I suspect the site coordinator spends a hundred times more time than I do on politics, the Democratic party and Obama’s reelection. By the time I arrived, a sign had already been posted outside the gym telling me I had arrived at the Democratic Caucus, and arrows pointed to where we Democrats were to proceed forward and enter the gym. Tables had already been set up with lists of registered voters where people would sign in to vote. When I arrived at my scheduled time, we were an hour away from admitting the voters, an hour and a half away from the opening speeches and two hours away from beginning the actual head count and vote.

My job was to be a precinct temporary chair, and I was to report to the site coordinator. I did that shortly after arriving when he asked if anyone had the packet for precinct 1327. Two days prior, I had gone through a two hour training program at the Nevada State Democratic Headquarters where we studied a booklet and were told what we needed to do to help out with the primary election process, and I left carrying a large envelope of materials which included copies of the precinct number I was to tape behind me in my corner of the gym to inform those voters living in precinct 1327 where they needed to meet with me to caucus and have their vote counted.

Once the caucuses began at 11:30 A.M., we first had to listen to the site coordinator read letters from Obama, Reid, Berkley, and Robert Lange. If you don’t recognize Lange’s name, he’s the Chair of the Nevada State Democratic Party. Some local candidates were introduced. Some woman spoke in favor of something to which I paid no attention. It was pretty much useless gab as we all waited to start voting.

The way it was suppose to work was first I was to count everyone who showed up in my precinct. In that regard, I couldn’t count myself because it really wasn’t my precinct. My precinct was voting at another high school about five miles further from my house, but the Democrats needed people willing to take the training and act as temporary chairs for precincts in which no one within the precinct had volunteered. They even had some diehard Democrats come in from California to serve as temporary chairs for some of those deadbeat precincts from whichno one had volunteered to be a temporary chair. By serving as a temporary chair for one of those precincts, I actually gave up being able to vote in my own precinct, and I could not be elected a delegate to the county convention which means I also cannot be a delegate to the state convention or the national convention. My sacrifice was supposedly so a number of other people could vote and participate in the system, at least that was the idea. Actually, if I bothered to know any of my neighbors, I could have asked someone in my precinct who went to the caucus at Spring Valley High School from my precinct to nominate me, but I don’t know any neighbors who are also Democrats who also went to the caucus.

Once I completed the head count, I had been trained to work through a formula to figure out how many votes each candidate needed for that candidate’s supporters to be able to elect a delegate or make their candidate “viable.” For precincts entitled to elect more than 4 delegates, a candidate needed 15 percent of the voters in the precinct to express their support for that candidate. I was figured that if half the people came as in 2008, then I would have about 70 voters in my precinct, and 11 voters would be needed to make a candidate viable since you round up to make for a half a person. (70 x 0.15 = 10.5 rounds up to 11.)

Precinct 1327 was one of the larger precincts, at least in terms of registered Democrats eligible to vote in that precinct, and it was eligible to elect as many as 15 delegates to the county convention. The precincts which set up next to me were only electing 7 or 9 delegates. Smalltimers, strictly small-timers. I had the big district, and I figured it was a good thing I wore my suit so the crowd would know who was in charge, that suit and the official looking Temporary Chair card I was wearing around my neck reminding me of my precinct number, the number of delegates it could elect, and on the back, the telephone number I needed to call to confirm when I arrived at the caucus and after the caucus to report the number of delegates elected for each candidate. Only us specially trained temporary chairs had the hanging tags and the other materials the caucus goers needed to have their vote counted. We also had other official looking stuff such as an agenda to post, a delegate calculation sheet to post, forms for people to use to sign up to be on the Clark County Democratic Committee, and a form to present a proposition to be considered for inclusion as a plank for the national party platform after the proposal had been screened by various layers of party bureaucracy and approved by the county and state conventions.

The booklet we were given at the State Democratic Headquarters suggested we temporary chairs bring with us a pocket calculator to do the math, a clock or watch to make sure we didn’t start the voting too early and stuff like extra pens, paper, markers and masking tape. I seemed to be the only person who brought his own masking tape, and it made me the center of attention until the voters started to arrive, that and the suit. I was the only one there in a suit.

It was a rainy, windy morning, and the winning candidate of the caucus was never in doubt. In Nevada, the Democrats who went to the caucus could either vote for Obama or vote for “uncommitted.” Even with nothing to little incentive to come to the caucus, the turn out was still very disappointing. Surprising disappointing compared with the madhouse four years ago. I only counted about 100 voters or maybe as few as five voters per precinct, in the entire gymnasium. Not a single voter showed up in my precinct. No one. I never got a chance to be elected precinctpermanent chair or show off my mastery of the mathematical formulas or read the antidiscrimination warnings prior to each vote or apply the double voting procedure designed to lessen discriminatory effect. To learn the latest voting technique designed to ease the effects of discrimination study the Democratic caucus voting rules. Democrats are always big on the discrimination stuff.

In the Las Vegas Review Journal the next day, Harry Reid was talking as if the Nevada Democratic caucuses had been a success even though only 12,600 voters showed up. Make that 12,601 to include me who showed up but could not vote. In 2008, more than 116,000 people had showed up, or more than 9 times as many people. In 2008, the Democrats actually registered 30,000 new voters, more than twice the total turnout this time around. Reid tried to throw a favorable light on the pathetic turnout by citing to 2004 when baby Bush was running for reelection, and only 3,000 Republicans turned out for the Nevada Republican caucus that year. So, looking at it that way, we had four times the turnout than did the Republicans under similar circumstances when there was no real contest and the final result was never in doubt.

The first thing we temporary chairs were suppose to do was nominate ourselves to be elected by his precinct caucus to the position of permanent chair. The Democrats always want to be fair, and they want you to be able to vote on everything, so even though only one person in each precinct had been trained to be the chair and only one person in each precinct was in possession of the voting materials, anyone could be elected chair. If by some chance some unexpected grassroots movement elected someone else chair of the precinct I had come to help, I was suppose to stick around and advise the chair about what they were suppose to do to have the delegates elected and to notify the party of the results.

So the idea was that I would become the permanent chair of the precinct in which I had come to help, the precinct which was filled to the brim with Democrats, but in which none of the precinct’s Democrats had the gumption to volunteer to help out the party, take a couple hours out of their day for the training and take on some responsibility to help run the caucus. Now, none of those deadbeats even came to vote on a rainy, windy day simply because they knew their vote didn’t matter anyway. Hey, we were suppose to rally the party. We were all suppose to come as a showing of unity, as a way of saying to the Republicans, “We don’t care who you put up against us. We’re coming to the fight.” Instead, we Democrats better hope the Democrats too lazy to come to the caucuses come out and vote in November. Learning the even more pathetic number of Republicans who went to their caucuses in 2004, give me some hope in that regard. In fact, you can say the Democrats are four times more likely to come just to say they showed up.

I also place the blame on the low turnout on that fact that it wasn’t well publicized. I read the newspaper every day, and I must have missed it, because just a week before the caucuses, I had to call down to the State Democratic Headquarters to find out the when and where. I had been called about two months earlier and asked if I planned to vote and whether I would volunteer to be a temporary chair. I said yes to both and then heard nothing until I call them back withing just five days of the vote. When I told them I volunteered and then heard nothing, they offered me times of three training sessions, and I went to the one on a Thursday night less than two days before the vote.

Being left to stand alone in front of my precinct sign in my corner of the gym with my only usefulness being my willingness to lend out my roll of masking tape, I wondered who lived in precinct 1327. Just who were those ingrates nervy enough to stand me up? Not that they knew I would be there, but would they have cared anyway? As it turns out, they all live in a few closely packed in housing subdivisions, and one cluster of condominiums, where everything has been built since 2003. All the homes have tile roofs, and they average about 1500 square feet of living space. Precinct 1327 is bordered on the north by Warm Springs, on the west by Jones, on the south by Robindale, and on the east by the railroad tracks. That’s where those deadbeat Democrats were all kicking back as I sat in a corner looking over a near vacant gym taking a little political smack with some of the other temporary chairs who were also stood up by their precincts as we enviously watched some of the other chairs organizing the voting in precincts where someone gave enough of a damn to come out and vote.

Statewide, only 1.7 percent of the delegates were elected as undecided. I sure wish I could have had some of those people in my precinct. A little action, a little political discourse, that’s why I had come. Four years ago the political discourse consisted of seventy people shouting O-ba-ma while another seventy people shouted back Hil-la-re. That kind of nonsense wasn’t going to occur in any precinct I ran. There was going to be some intelligent discussion of the issues with me being prepared to predict that by October 1, 2012, the Dow will be over 14,000 and the unemployment rate will be below 6.6 percent.

So in the end, I called in my vote count and worked my way through the voice menu, number of voters, zero, number of delegates for Obama, zero, number of delegates for undecided, zero, and I hung up, gave my sealed envelopes to the site coordinator to be delivered to the state party and the county party headquarters, each containing a copy of a single delegate slip with no name on it and only a message that no one cared to come to vote in precinct 1327. I then removed from the gym wall the precinct numbers and arrows and agenda and other stuff I had taped up and put it all back in the large envelope I had brought with me with high expectations of doing something worthwhile. I then went home to watch the election news for the Republican primary in South Carolina on MSNBC with the hope that the Republicans would keep fighting among themselves right up to a brokered convention.

I was talking to a friend on the phone today. He was telling me how he was selling more books on Amazon. He said that he listed his book for free for a few days, offered it as some kind of promo and it stimulated sales of just about hundred of his books in about 48 hours. I was already blown away by the success he’s had selling his book to begin with. He has two books for sale on Amazon currently and he tried this with both books. One of the books sold more copies when the promo ended, but it’s also been listed on Amazon longer than the other book has, but I’m not sure it that had anything to do with the result. I’m not sure if there’s anything to this statistic, but I found it very interesting. I’m looking forward to publishing my book on Amazon in about 30 days, to see what kind of results I get and look forward to implementing his marketing strategies.

NEW UPDATE! The new fan site is going live!! andreiamichaelssucks.com

Because of the popularity of this post, it needs to be its own website!! So in a effort to recover cost related to the nonpayment of Andreia Santos to Scott Asher for wages. I will move the entire post to its very own website IN JUST A FEW DAYS!! AND!! All I will even use the web design I made for andreiamichaels media company as my design for my fan site!!

The stats for this post – yesterday 1/17/2011

Hers it is Christmas time just about 11 days away from Christmas an I get stiffed again!! Marry Fucking Christmas to ME! I was hired by Andreia Santos to work on the andreiamichaels.com website, a new media company coming to Las Vegas.

While reading this some of you might think this is inflammatory in nature, but think of it this way. When I do work for someone, and they refuse to pay for my time. What you see in this blog post is all I have left. I look at life like this… life is content, this is my life, this is my content. Sit back and enjoy, I have another fascinating story for you to enjoy.

I guess “andreiamichaels.com” is some new media company coming “into town” to the Las Vegas area, from Irvine California, and they wanted to get a website done, I am not even sure on all the details myself. And-never-the-less they hire me to design their website! Thank you Jesus! I finally won the lottery right? I broke down and got myself a job. To be honest it was kind of a relief, I figured – finally I could get some bills paid, the economic outlook is not fun right now to say the least!

Below I have listed the cold hard facts in this case, and an outline of what I am claiming, with my supporting evidence. All the emails and text message correspondence with me an miss Santos are posted at the bottom. Its going to take me a few days to get 100% of everything posted, but I think you will find the important ones are already posted.

The Story

I was hired as an employee by Andreia Santos to work on the AndreiaMichaels.com website and other websites for 40 hour a week job, and take a salary. All of that abuptly ended after I had a very strange 3 way phone call with some guy and Andreia Santos. To be honest all I can remember this guy telling me,”how did I get though the door?” an I have no clue what that means, but the phone call was sooo strange. At that point I thought this situation was just way too strange to continue.

So like any normal person I want to get paid for my time.

Facts

I was hired from 7th to the 14th.

So I guess the bottom line here is Andreia Santos feels like I have done nothing, and deserve nothing for my time, and does not want to pay. I have posted my prof, along with all the email and text messages here in this blog post.

According to my contract terms for a term of 7 days (Dec 7th-14th), according to what is on my contract, I am salary, and I am claiming I am owed money for non payment.

Outline of the work I am claiming I have done.

I have had 152 text message correspondence with Andreia Santos - They are all currently posted at the bottom of this post. And I would like to point-out one valuable point, for just 40 hours of work, that is a little more than “3″ text messages an hour for the 40 hours! That has got-to be worth something, I mean Jesus, my cell phone cost something every-single month!

I also received approximately 30 emails from Andreia Santos in one way or another related to AndreiaMichaels.com website project, for the sake of simple math, that is just under one email per hour of work based on the 40 hours, I mean com-on, that is worth nothing too? Remember, I am an employee here!! I am also going to post the employment contracts for you to view!

I got hired at a Panera Bread, I am really nervous here. I was only able to get Iphone snapshots of my employment contract, this seems really shady.

I am also going to posted the 2 layout pages I made, that happens to be posted here under this, and the art work I have done for Andreia Santos.

Look at these layouts, is this nothing??? The Layout on the right and the left is what was presented to AndreiaMichaels or Santos rather. I made these from the details and logo provided to me by Andreia.

Does this work look like something I came up with while I was chugging down a bowl of Diggem-Smacks?

Her emails

Andreia Santos providing me with more details

It is going to take me a few to post all these emails, but trust me the good-ones are already posted!!! If you read from the bottom up you really get a feeling for what I am dealing with here.

Just forward me the workable site or/and what youve completed and we will have your check on Friday. All I show is a Photoshop image of 2layouts, 20 minute Starbucks meeting on your request to show me what you could have shown me via an email and a snapshot of a sushi logo is all I have so far.
I just need the work that validates the 32 hours you claim to have put in.As for work done yesterday (show me) you said you didn’t feel creative and had nothing for me… And my godaddy acct has no changes that you said you made.. and today.. I have nothing either. We just called for a progress and you cursed at us and quit.I’m shocked that you would just curse at me and text me that you’re done when all we asked for was an update and progress report. Please just forward me the completed work and I’ll be more than happy to pay you for your efforts. I’ve been doing this for 7 yrs and I’ve never been cursed at, not cool. I pay my employees and am just looking to build a good team. The whole thing is just a surprise to me.Andreia SantosSent from my iPhone

Provide me with the work you did complete. Unless you are telling me that such an accomplished web designer is only able to provide me with 2 Photoshop images and it took you 36 hours to complete which in that case is only a poor reflection on your lack of talent. Is that what you intend to post!

I’ve been in this business for 7 years, I’ve run into my share of lazy has been designers, or in your case “never were” since you felt compelled to quit to second you were ask for your progress. So give me real amount of time that you spent on my project because my calls (logged from my Verizon bill totaled 47 minutes and the work hmmmmm let’s go over that

3 minutes to swap out a background on twitter

Two images of a very similar image to a template of a site you have on your very site done in photoshop and then lets remember that you never showed me anything else after our “meeting” for 17mins at Starbucks which you insisted on while I was on location working and interrupted my shoot!

Don’t make this a battle.

Just Be honest with yourself!

Your contract started on the friday the 9th and you quit via phone call the minute the bullshit was being discovered on Tuesday the 13th. Let’s face it you were going to milk this for a month just the squeeze out pay.

You hung up and then text me curses and admitted to QUITTING because you could not DELIVER a site! 3 weeks was a joke to complete a website! if you had said that at our initial conversation I would have found a project based designer and saved the waste of time and money!

And regarding “feeling creative” as you repeated wrote! The logo I asked you to copy was a very precise image of a flame. And you sent me something completely opposite of a image that I found on logopond.com of a fish from a resturant which shows me that you just copied it and emailed to me.

Look I realize that you did put in some work with photoshopping a templete to show me on Friday but I have nothing for work from saturday Sunday Monday or Tuesday. Provide my agency with something tangible and keep your threats about posts to yourself. I’m not your “former business partner” and I will absolutely file a defamation lawsuit against you and will promise that you will be the one the looks terrible in this situation since you want money but gave me 10 hours of work! (According to six of my designers that have looked at your bs work) Tops! I am looking to hear back from you provide me with valid work for the unrealistic hours you claim! 32hours I should have ten logos and the framed out site. You did nothing and I have the texts to prove that. No threats! Just be honest please you quit I was giving you the benifit of doubt and hoped you would show my something. I can make a photoshop templete of what I want a site to look like! Let’s be honest here!

This Is so sad that I was nothing but kind to you and come back with threats.

This is clear fact, It is clearly date stamped on the screenshot.

And if you say you never “never refused to pay me” then pay me!? That would clear all this up

And I am not sure how I would bait and switch you, I was employee of your company.

And thank you very much Andreia, I wish you well also.

We have an update to the story!

About two weeks ago Ms. Santos contacted my attorney Robert Kossack in trying to settle the matter for my unpaid wages. Robert and I agreed to settle the matter with Ms. Santos for what I think is a very reasonable amount of $250 plus a small fee for my attorneys time. That offer is no longer on the table, my guess is that I was never going to be paid in the first place and that Ms. Santos was just using me to put her website up.

The email from Robert Kossack .esq my Attorney to Ms. Santos

Dear Ms. Santos,

On Tuesday, January 3, 2012, you and I came to an agreement for you to pay Scott R. Asher, with payment sent to this office, $250.00 plus some of Scott’s attorney fees to compensate me for my involvement in negotiating the settlement of Scott’s claim against you for payment for his services working on a website for your company. Upon us reaching our agreement, Scott removed from his website a blog related to your nonpayment. You settlement payment was expected to be received by this office by Thursday, January 5, 2011.

On January 5, 2011, I was notified by Scott that you had texted him a message reneging on our agreement and saying you were not going to pay. I then called you and asked for clarification. You said you did not text Scott such a message and that you had ordered payment and that you would confirm that payment was sent. However, payment was not received on Friday, January 6, 2012, and today is Monday, January 9, 2012, and payment still has not been received, which means to me that contrary to your denials, promises and representations, payment never was sent to Scott in care of this office as per our agreement.

Thus, Scott reposted the blog discussing his dealings with you, and that blog will not come down so long as you fail to honor our settlement agreement.

On a more serious note, the evidence is that you were dishonest with me and wasted my time when we settled the dispute between you and Scott. Thus, you will need to send Scott’s check over by personal delivery to this law office (Kossack Law Offices, 4535 W. Sahara Ave., Suite 101, Las Vegas, Nevada 89102) so that it is received between 2:00 P.M. and 4:00 P.M. tomorrow, Tuesday, January 10, 2012, or I will be adding to Scott’s blog with a discussion about how you dealt with me in bad faith and failed to honor our settlement of Scott’s claim.

I have tried to call you several times regarding this matter, and each time have received no answer, and your voice mailbox is full and, thus, I am sending you this email.

Sincerely,

Robert J. Kossack, Esq.

cc: Scott R. Asher

Now, not only does Ms. Santos owe me money she also has a legal bill do with Robert Kossack and unfortunately for myself and Robert we are victims of not being paid for our services from Ms. Santos. The good news for me is, Ms. Santos has included Mr. Kossack my attorney as a witness for the case when I file my lawsuit against her. So now, she does not only owe me money for my wages, she also owes Mr. Kossack at least two hours for legal services at $350 an hour. So, the plot thickens. Stay tuned for even more on this story!

Another UPDATE! 1/17/2012

This is a 100% non-paid review for WordPress membership plugins. I had been working on some of my clients WordPress websites, and I purchased WordPress Member plugin for the Authorize.net gateway.

The WordPress website was currently using WordPress’s eMember plug-in and I was very impressed up to this point, but the client wanted to add Authorize.net payment gateway to their website. So we decided to switch to the WordPress Member plugin

So back to what happened, I was switching membership plugins from the WordPress eMember to the WordPress Member and I could not for the life of me get WordPress Member plugin working. The problem was that I was getting a white screen anytime I went to login to the WordPress CMS or update the changes I made to the plugin or refresh the page. And the way WordPress Member plugin was made, there was nothing I could even do to troubleshoot the problem – the WP Member plugin code was encrypted.

The other thing I didn’t particularly care for was the poor technical support offered for the WP Member plugin. From what I could tell, WP-Member was trying to charge for support of their own plugin, which in my opinion was just crazy.

The price for the plugin was $29.99, I am not sure it was worth much more than that.

Most of the support I found for the WordPress Member white screen issue was online and was telling me to deactivate plugins one-by-one in an attempt to find the problem plugin. But the problem plugin was in fact the WordPress Member membership plugin. My guess was the WordPress Member worked poorly in a shared hosting environment or I could of had some theme conflicts. But one thing is for-sure, once I got rid of the WP Member plugin, my problem was gone.

The WordPress Member plugin was crap. I never got the plugin working, so we just decided to stay with the eMember plugin. I have yet to get a reply from the developer or technical support on the “white screen” issues I was having. The good news is my client is going to stay with WordPress eMember, and add the Authorize.net WordPress plugin.

I found a solution for membership websites looking to easily add the Authorize.net payment gateway to their membership website, check it out http://www.danielwatrous.com/authorizenet-for-wordpress

For some reason ChexSystems seems to be slipping out of the picture. I have opened 2 checking accounts recently (last 3 months) and from what I can tell, less banks are using the chexSystems bank account verification system. Then the other day a buddy of mine tells me about a new thing banks are using called Early Warning Systems or (EWS)

So who is EWS? creditinfocenter.com says: Early Warning Services is a limited liability company owned by Bank of America, BB&T Corporation, JPMorgan Chase, Wachovia, and Wells Fargo. From their website describing services to financial institutions.

I think – because banks are now charging $10 a month for bank/checking accounts, the dynamics have changed and banks are opening at risk accounts.

I also was reading, that complaints filed with ChexSystems, are also filed with EWS, I am not sure that is %100 true.

This is “the post” that is the bottom line of any web business. This is where I explain in numbers how I turned $12.00, the cost of my domain, into a million dollar empire never sleeping, turnkey empire! One thing is for sure, if I can do it, you can too. That you can take to the bank!

Let me take your hand and show you how anyone can make passive income with an investment of only $12.00. Making money on the web is more common than what you might think. Who doesn’t own their very own blog? If you are looking to make money developing a online business, then what I have to say might interest you. I specialize in venture capital, creative concepts, fund-raising, micromanagement and unique web content. There is nothing for sale on this page. I made this page to display my results from owning a blog, a blog journal. I use this page to publish my results, stats, payments I post everything.

Let me be clear, the direction of making money is moving towards the web. The proliferation of sites like Facebook confirm that most people will at some point have a personal website or be willing to load their personal content on the internet for others to view. For example, nine out of ten people have Googled someones name, looking for possible negative information about them. I have even ordered a pizza from a website, so you know this “web-thing” is catching on in a really huge way. Making money has always been about “getting in the way” of a transaction. And more and more, transactions are done over the internet.

This blog is my electronic business card–my mouthpiece. I made this blog to show that money can be made from almost anything. When others try to conceal their snake oil, get rich quick schemes, I am the magician willing to expose the secret of the illusion. A friend of mine asked me, “Are you worried someone will take your idea?” No, I am not. I offer them like candy, take one and use it if you like. I’ve moved on to another idea already. I have forgotten more ways to make money, then most will ever know. I am the modern day prospector.
